Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Mountain49 LLC architecture (the "Service") and any IT consulting, Data Engineering, or E-commerce deployments provided by Mountain49 LLC ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these corporate Terms. If you disagree with any part of the terms, you may not access the Service.

1. Consulting and Development Services

When engaging Mountain49 LLC for architectural deployments (including Foundation Build, Growth Partner, or Enterprise Retainer tiers), specific deliverables, timelines, and payment structures will be detailed in a separate Statement of Work (SOW) or Service Level Agreement (SLA). In the event of a conflict between these Terms and an SLA, the SLA shall govern.

2. Intellectual Property

The Service and its original proprietary codebases, algorithms, and architectures (excluding content provided by you) are and will remain the exclusive property of Mountain49 LLC and its licensors. The Service is protected by copyright, trademark, and other laws of the United States.

3. Corporate Obligations

As a user of our Service or client of our enterprise firm, you agree not to:

• Use the infrastructure in any way that violates any applicable national or international law or regulation.
• Attempt to reverse-engineer, decompile, or disrupt any parts of the Service or the cloud servers on which the Service is hosted.

4. Limitation of Liability

In no event shall Mountain49 LLC, nor its directors, engineers, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or operational capacity, resulting from your access to or inability to use the infrastructure.

5. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.
